บริษัท บีซีเอสเอ็ม 1989 จำกัด ("บริษัท") ในฐานะผู้ควบคุมข้อมูลส่วนบุคคลตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (PDPA) อธิบายในนโยบายนี้ว่าเราเก็บ ใช้ และเปิดเผยข้อมูลส่วนบุคคลของผู้ใช้บริการสถานีชาร์จและแอปพลิเคชันของเราอย่างไร

2. วัตถุประสงค์และฐานทางกฎหมาย
- ให้บริการชาร์จและเรียกเก็บเงิน — เพื่อปฏิบัติตามสัญญา
- ออกใบเสร็จ ใบกำกับภาษี และจัดทำบัญชี — เพื่อปฏิบัติตามกฎหมาย (ประมวลรัษฎากร พ.ร.บ.การบัญชี)
- ตอบคำถาม แก้ปัญหา คืนเงิน — เพื่อปฏิบัติตามสัญญา
- ดูแลความปลอดภัยของระบบ ป้องกันการทุจริต — ประโยชน์โดยชอบด้วยกฎหมาย
- แจ้งโปรโมชันและข่าวสาร — เฉพาะเมื่อได้รับความยินยอม และถอนความยินยอมได้ทุกเมื่อ
3. การเปิดเผยข้อมูล
เราไม่ขายข้อมูลส่วนบุคคล เราเปิดเผยข้อมูลเท่าที่จำเป็นให้กับ:
- ผู้ให้บริการแพลตฟอร์มบริหารสถานีชาร์จและแอปพลิเคชัน (ผู้ประมวลผลข้อมูลภายใต้สัญญากับบริษัท)
- ผู้ให้บริการรับชำระเงินและธนาคาร
- ผู้ให้บริการระบบสำรองข้อมูล/คลาวด์ อีเมล และ SMS
- พันธมิตรเครือข่ายชาร์จ (roaming) เฉพาะเมื่อผู้ใช้ชาร์จผ่านแอปของพันธมิตร
- ผู้ทำบัญชี ผู้สอบบัญชี และหน่วยงานรัฐเมื่อกฎหมายกำหนด เช่น กรมสรรพากร
ผู้ให้บริการบางรายอาจเก็บข้อมูลบนเซิร์ฟเวอร์นอกประเทศไทย ซึ่งบริษัทจะดำเนินการให้มีมาตรการคุ้มครองตามที่ PDPA กำหนด
4. ระยะเวลาเก็บรักษา
- ข้อมูลบัญชี: ตลอดเวลาที่ผู้ใช้ยังมีบัญชี และลบหรือทำให้ไม่สามารถระบุตัวตนได้ภายใน 30 วันหลังขอลบบัญชี
- ข้อมูลการชาร์จ การชำระเงิน และใบกำกับภาษี: ไม่น้อยกว่า 5 ปี และไม่เกิน 10 ปี ตามที่กฎหมายภาษีและบัญชีกำหนด
- ข้อมูลทางเทคนิค: ไม่เกิน 12 เดือน
5. สิทธิของเจ้าของข้อมูล
ท่านมีสิทธิขอเข้าถึง ขอรับสำเนา ขอแก้ไข ขอลบ ขอระงับการใช้ คัดค้านการประมวลผล ขอโอนย้ายข้อมูล และถอนความยินยอม รวมถึงร้องเรียนต่อสำนักงานคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล เราจะตอบคำขอภายใน 30 วัน
6. ความปลอดภัย
ข้อมูลรับส่งผ่านการเข้ารหัส (HTTPS/TLS) จำกัดสิทธิ์การเข้าถึงเฉพาะผู้ที่จำเป็น และผู้ให้บริการภายนอกมีหน้าที่รักษาความลับตามสัญญา
7. ผู้เยาว์
บริการนี้สำหรับผู้มีอายุ 20 ปีบริบูรณ์ขึ้นไป หรือผู้ที่ได้รับความยินยอมจากผู้ใช้อำนาจปกครอง

BCSM 1989 Co., Ltd. (the "Company"), as data controller under Thailand's Personal Data Protection Act B.E. 2562 (PDPA), explains here how we collect, use and disclose personal data of users of our charging station and app.
1. Data we collect

2. Purposes and legal bases
- Providing charging and billing — contract
- Receipts, tax invoices and accounting — legal obligation (Revenue Code, Accounting Act)
- Support, troubleshooting and refunds — contract
- Security and fraud prevention — legitimate interest
- Promotions and news — only with consent, which you may withdraw at any time
3. Disclosure
We do not sell personal data. We share only what is necessary with:
- Our charging-management platform and app provider (a processor under contract with us)
- Payment providers and banks
- Cloud hosting, email and SMS providers
- Roaming partners, only when you charge through a partner's app
- Our accountants, auditors, and government authorities where required by law (e.g. the Revenue Department)
Some providers may store data outside Thailand; we ensure safeguards required by the PDPA.
4. Retention
- Account data: while your account is active; deleted or anonymised within 30 days of a deletion request
- Charging, payment and tax-invoice records: at least 5 and up to 10 years as required by tax and accounting law
- Technical data: up to 12 months
5. Your rights
You may request access, a copy, correction, deletion, restriction, objection, data portability, and withdraw consent, and may complain to Thailand's Personal Data Protection Committee. We respond within 30 days.
6. Security
Data is encrypted in transit (HTTPS/TLS), access is limited to those who need it, and third-party providers are bound by confidentiality obligations.
7. Minors
The service is intended for users aged 20 or over, or with consent of a parent or guardian.
